The list is intended to be representative and illustrative of our various practice areas, but not exhaustive. Many interesting and important transactions have been excluded. For purposes of confidentiality, no specific reference is made to a particular client. COMMERCIAL LAW

  • Workout of multi–million dollar loan with full recovery involving multiple tracts of land, legal malpractice litigation and title insurance issues.
  • Closing of multi–million dollar loan involving multiple residential and commercial tracts of land, creditors and bankruptcy issues.
  • Obtained favorable IRS determination letters for numerous tax–exempt (IRS Code 501(c)(3)) organizations.
  • Represented local bank in litigation and work–out of deficient multi–million dollar loan.

  • Represented the acquirer in the first hospital acquisition under Georgia’s recently enacted Hospital Acquisitions Act.
  • Assisted with the development and implementation of a hospital legal compliance program.
  • Represent a hospital–based Management Services Organization (MSO) in all aspects of operation, including practice acquisitions, legal compliance, billing and contracting.

GENERAL TRIAL AND LITIGATION

  • Represented Builder/Developer in significant construction arbitration under the auspices of the American Arbitration Association.
  • Successfully pierced corporate veil in fraud litigation involving automobile dealership.
  • Obtained significant settlement in a wrongful death case involving the death of two individuals because of a defective road shoulder.
  • Represented an individual injured because of a defective manufacturing machine.
  • Represented individuals injured because of defective seat belts.
  • A significant settlement against a pharmaceutical maker of the weight loss drug Fen–Phen.
  • Represented several persons injured in a catastrophic van accident involving a defective tire and excessive speed. Tisinger Vance, P.C. obtained significant settlements from both the owner of the van and the manufacturer of the tire.
  • Obtained a significant settlement against a trucking company in a wrongful death case involving a runaway truck.

INSURANCE DEFENSE

  • Defense Verdict in a Slip and Fall case in which Plaintiff demanded $150,000.00 for allegedly falling through a rotten floor of her landlord’s chalet and injuring herself. Her husband joined in, seeking $50,000.00 for alleged loss of consortium. The Defense was able to expose Plaintiff’s extensive past and subsequent medical history which operated to impeach both Plaintiffs to the point the jury didn’t believe either the deposition testimony of the allegedly injured Plaintiff or the trial testimony of either Plaintiff. After a three–day trial, the jury deliberated a little over an hour before returning a Defense Verdict in favor of our client, the Landlord.

MEDICAL INDUSTRY

  • Developed a physician recruiting program for hospitals through which over 40 physicians have been successfully recruited in the last five years.
  • Represented the acquirer in the first hospital acquisition under Georgia’s recently enacted Hospital Acquisitions Act.
  • Assisted with the development and implementation of a hospital legal compliance program.

MUNICIPAL LAW

  • Assisted property owners and developers in reversing adverse zoning decisions for 1,000–lot subdivision.
  • Drafted initial County Zoning Ordinance.
  • Served as local bond counsel for hospital, school and water system construction funding.
  • Represented local government and property owners in ad valorem tax litigation, including freeport exemption issues.
  • Defended Carroll County in federal court litigation over jail conditions.
Since 1995, Tisinger Vance, P.C. has recovered Millions of Dollars in Verdicts and Tens of Millions of Dollars in settlements representing the injured in West Georgia and Atlanta.

PERSONAL INJURY

  • Personal Injury Caused by Slip and Fall in Restaurant
  • A restaurant patron alleged he was injured after an employee mopped portion of dining area with soapy water and did not put proper warning signage out. The patron incurred medical expenses, surgical expenses, lost income and pain and suffering. This matter settled before trial for $325,000. Gilmer v. Hong Kong Chinese Restaurant, Carroll County State Court.
  • Wrongful Death and Personal Injury Caused by Natural Gas Explosion
  • A homeowner was injured, his wife was killed and his and her home was totally destroyed by a natural gas explosion. The allegations against the natural gas company were settled before trial in a confidential cash settlement. The matter was tried against the HVAC contractor before a jury in Carroll County State Court, resulting in a verdict in favor of Plaintiffs for $670,000. Smith v. AGLC, et al., Carroll County State Court.
  • Personal Injury caused by Tractor Trailer Accident
  • A man driving a pickup truck alleged that he was struck by a tractor-trailer causing serious physical injuries, including a fracture to his C-spine (neck). The tractor trailer allegedly made an improper U-turn in front of the man’s pickup truck. The gas tank exploded during the collision. The matter was settled before trial for a confidential cash settlement. Davis v. Stephens, et al., U.S. District Court.
  • Personal Injuries caused by a Commercial Vehicle Accident
  • A commercial vehicle driver and his employer settled a vehicular accident case before trial for a mid-seven figure settlement. [Names Withheld].
  • Personal Injuries caused by a Tractor Trailer Accident
  • A man driving a car alleged he was involved in a multiple car accident caused by a tractor-trailer driver allegedly over-tired under the influence of prescription medication. The man alleged he had serious personal injuries, medical expenses, lost wages and pain and suffering. The matter was settled just before trial for a confidential cash settlement. Rogers v. Sara Lee Corp., U.S. District Court.
  • Personal Injuries caused by a Tractor Trailer Accident
  • A father, mother, and their two young children alleged they were injured when their SUV was side-swiped by a tractor-trailer during an accident on I-285. They alleged the tractor-trailer had improperly maintained, bald tires which caused a tire blowout. Their SUV rolled over several times, struck the center concrete wall and then slid back across the Interstate. The matter was settled before trial for a confidential cash settlement. Webb v. Anderson, et al., Fulton County State Court.
  • Fractured Leg caused by Defective Door
  • A woman with disabilities alleged she received a compound leg fracture after being struck by a rapid-closing, overly forceful door that did not give her adequate time to walk through. The door was allegedly non-compliant with the Americans with Disabilities Act (ADA). The matter was settled before trial for a confidential cash settlement. Gay v. DGS Automotive, Inc., Cobb County State Court.
  • Fall Caused by Allegedly Defective Balcony Railing
  • A man alleged he was injured when he fell from a third story balcony at a Jamaican resort. He alleged that a rotten wooden railing had been inappropriately painted over with fresh paint rather than being repaired. He alleged that during the fall, he received a back fracture, resulting in medical expenses, lost wages, inability to work in this current job and pain and suffering. The matter settled before trial for a confidential cash settlement. Geibel v. Sandals Ocho Rios, Ltd., Fulton County State Court.
  • Molestation of Incapacitated Adult
  • An adult man suffering from mental and physical disabilities alleged that he was sexually assaulted and molested by an employee at a personal care home. The matter was settled before trial for a confidential cash settlement. [Alleged Victim’s Name Withheld] v. The Frazer Center, Dekalb County State Court.

  • Represented the family of two individuals killed because of a defective road shoulder.
